Insurance Requirements on Rented or Leased Equipment

You’ve made the right choice in doing business with Road Machinery. We’ve outlined below Road Machinery’s insurance requirements.

All customers are required to have a general liability insurance and physical damage insurance.

Off – Highway Construction Equipment

1). Commercial general liability insurance: $250,000 or the value of the equipment, whichever is higher, per occurrence, covering:

* Customer’s operations

* Road machinery as additional insured

2). Physical damage insurance: Full value of equipment, covering:

* Rented or leased equipment using contractors’ equipment floater form or comparable form

* Name Road Machinery as loss payee

3). LOSS AND DAMAGE WAIVER: THE “LOSS AND DAMAGE WAIVER” IS NOT INSURANCE. If Customer has accepted and paid for the Loss and Damage Waiver on pg. 1, Lessor agrees that Customer will not be responsible for direct physical damage to the Equipment if it is used for its specific purpose and not misused in any fashion. However, Customer is responsible for a $2,000 servicing fee on all actual losses or damages that are waived by this paragraph, and Customer is responsible to Lessor for rent that the Equipment would have earned while the Equipment is unusable or being repaired. Notwithstanding the foregoing, Lessor will not waive and Customer will be liable for all resulting loss and expense of Lessor if Equipment is used or operated in any of the following manners: (i) misuse or improper (un)loading; (ii) failure of Customer to perform all periodic and other basic service, adjustments and lubrication of Equipment, as indicated in the manufacturer’s operations and maintenance manual; (iii) use or operation of Equipment in a manner inconsistent with the manufacturer’s instructions; (iv) loss of or damage to Equipment during periods of riot, strike or civil commotion; (v) reckless or abusive use or operation of the equipment.; (vi) striking overhead objects; (vii) loss or damage occurring during transportation of Equipment, (viii) use or operation of Equipment in a hostile or warlike manner; (ix) any loss or damage to tires or tools, unless coincident with other protected loss or damage; (x) any loss or damages by any type of nuclear reaction, radiation or radioactive contamination; (xi) disappearance of Equipment or theft or conversion of Equipment not documented by Customer’s immediate notification of the police and compliance with the REPORTING paragraph below, or if Equipment is lost in any of the listed manners while it was not stored in a fenced locked yard; (xii) all loss or damage associated with Equipment; (xiii) use or operation contrary to the USE paragraph above and/or (xiv) all damage associated with excessive wear and tear.

Insurance carried by Road Machinery is not intended to cover the Customer, Customer’s employees or any person to whom the Customer may entrust the equipment. The maximum amount of coverage available to a person or entity, other than Road Machinery, required by law to be an isured on Road Machinery’s policy, will be the limit of insurance needed to comply with the minimum provisions of the law in the appropriate jurisdiction.
